This Agreement is between you (“you”, “your”, “customer” “tenant” or “User”) and Photolet Qatar (“Photolet Qatar”, “Photolet” “us”, “we”, “our”, or the “Company”). Photolet is a Qatari registered company with its registered offices located on the 3rd floor, Union Trust Tower, Lusail, Qatar. Photolet provides its customers with a variety of in-studio logistical services such as recorded/live TV production for the benefit of TV channels, media production agencies and talk-show TV shows, As well as supporting services such as videography/photography gear, audio recording devices and decorative design works.
By using our services, whether through our website or through accepting a rental Agreement, cooperation or provision of services of any kind by us, and whether the request for these services is online through our website or through other means of communication, or by your presence at the Company’s office, you acknowledge that you are fully aware of this Terms and Conditions Agreement. Any additional policies, guidelines or rules on our website or provided to you in a writing form, which are not included in this Agreement, shall be considered a part of this Agreement, and you agree that you have carefully read and accepted all of the below Terms and Conditions.
Photolet has the right to reject any rental request, and it is not obligated to give reasons for rejection. The Company also reserves the right to request a security deposit before approving any rental application. The customer gets the full security deposit back after returning the studio and/or gear to Photolet.
The customer has the right to use the studio and gear only from the beginning of the rental period until its end. Photolet retains absolute ownership of the studio and gear, and the customer is not entitled under any circumstances to claim ownership of the studio or gear for himself/herself or for others.
Receipt and return location for studio and/or the gear done at Company’s office and at the official announced working hours.
Photolet inspects the studio and the gear before handing it over to the customer, and makes sure that it is working well and in good condition. The customer must do a second check upon receiving the studio and/or the gear that it is faultless and working well. In the event of defects in the studio and/or the gear, Receipt will list them in the reception report.
Rental fees are fully paid in advance for the entire rental period. If the customer asks to extend the rental period, the customer is obligated to pay for the additional period as soon as Photolet approves their request.
The customer has the right to request cancellation, provided that Photolet is notified 24 hours before reception date, in which case the customer is refunded what they paid minus 10% charged as restocking fees. In the event that Photolet is informed of the cancellation on the same day, the customer will not be eligible for a refund.
In the event that the rented gear is not returned on the agreed date, and Photolet has not been informed about the desire to extend the rental period, or to informed about the delay reasons, a delay fine equal to (QR 500) will be charged for each day of delay. Photolet reserves the right to report the gear as stolen to law enforcement agencies and to take the maximum measures permitted by law to collect it and/or obtain appropriate compensation.
The customer can postpone the receipt of the studio and/or the gear without being charged an additional fee, provided that Photolet is informed of the desire to postpone 24 hours in advance.
The customer is obligated to make every reasonable effort to maintain the studio and the gear, and protect them from any hazards that may affect their performance, such as, but not limited to, the risk of falling, shock, liquid leaks, exposure to high temperature, electrical related hazards, or using incompatible accessories, in addition to the risk of theft and loss. The customer is obligated to return the studio and the gear in the condition in which they received it before the end of the rental period.
The customer is obligated to use the studio and/or the gear for the purposes for which it was designed and under the operating conditions specified by the equipment manufacturer as set out in the operating manual for the product.
The customer is not allowed to disassemble cameras, lenses or any other photography gear by himself/herself or through a third party; the customer is not allowed to make any permanent or temporary modifications to them; the customer is not allowed to remove or apply any stickers or write on them.
The customer is solely responsible for compliance with any applicable laws and regulations in qatar in regard to using the rented gear. For example, but not limited to, the customer is obligated not to film in places where filming is not authorized, and is obligated to obtain required filming licenses, whether inside or outside photolet’s studio, if required by the relevant authorities.
The customer is obligated not to use the studio and/or the rented gear for any purposes that are considered to be in violation of laws or regulations in Qatar, or public morals and customs. The customer is obligated to convey these instructions to their employees/photographers and inform them of the consequences that may result upon violating. In all cases, the customer is solely responsible before the authorities and law enforcement agencies in the event of a violation of these instructions.
The customer is solely responsible for violations of laws or regulations, and neither Photolet nor any of its employees or directors shall be liable for the use of its studios, cameras or gear in a manner that violates applicable laws or regulations in Qatar. The customer is solely responsible for the consequences of these violations, whether they are towards a government entity, individuals, or institutions.
The customer is obligated that they intend to use the studio and/or the gear himself/herself or through an employee or photographer working for himself/herself. The customer is prohibited from subleasing the studio and/or the gear to a third party, lending it, mortgaging it, or donating it. In the event of a violation, Photolet reserves the right to terminate the rental Agreement, while charging the full rental fees for the agreed period, in addition to charging the customer any additional compensation at its own discretion.
According to Qatari law, indoor smoking is banned; the customer and all their staff are obligated to refrain from all forms of smoking (including cigarettes, electronic cigarette (vape), cigars, pipes, etc.) in the studio and inside the building in general, instead, there are some smoking areas in the tower.
The customer and all their staff are obligated to refrain from bringing food and eating inside the studios.
The customer is obligated to use the gear within the borders of Qatar, if they wish to transport it abroad, the customer must inform Photolet first, Photolet has the right to accept or reject the transportation request abroad without giving any reasons, in case of acceptance, the Company may require additional security deposit.
In the event that any of the rented gear is stolen, the customer is obligated to inform Photolet, and they must file a report with law enforcement agencies.
The customer is obligated to inform Photolet immediately in the event of any damage occurred to the studio and/or gear; in this case, the customer is obligated to return the gear to Photolet, to take the necessary procedures, and not to attempt to repair it himself/herself or through a third party.
If the customer causes partial or full damage to the studio and/or gear, whether such damage was caused by the customer himself/herself by or one of their employees, photographers, or any other parties, or some or all of the gear or parts of it were lost or stolen. The customer is solely obligated to compensate Photolet in a value equal to the cost of the damaged, lost or stolen gear. Photolet will determine the fair compensation value according to its own without regard to the current or previous price of the gear.
The customer is obligated to compensate Photolet for any material or immaterial damages that occur to the Company or gear due to their violation of laws or regulations, for example, but not limited to, the customer is obligated to compensate Photolet for the confiscated gear, and in such cases Photolet will determine the fair compensation value according to its own without regard to the current or previous price of the gear.
In the event that the customer returns gear with missing parts, the customer is obligated to return the missing parts to Photolet within two working days.
Photolet pays great attention to the privacy of its customers’ data. The Company needs to collect some personal data, such as names, addresses, email addresses, phone numbers, etc. for the purposes of communicating with customers and completing rental requests. Photolet is committed to make every effort to maintain the confidentiality of its customers’ data and not to disclose it to third parties without their approval. In some cases, Photolet may be compelled by law to provide certain customer data in response to a request from law enforcement agencies or authorities.
All services and products offered by Photolet are provided “as is” and “as available” without any express or implied warranties of any kind. Photolet and its directors and employees make no warranty that Company’s products or services: (i) will meet your requirements; (ii) will be available at all times; (i) will be suitable for a particular use; or (iv) will be error-free.
You expressly understand and agree that photolet and its directors and employees shall not be liable to you for any direct, indirect, incidental, consequential or exemplary damages, including, but not limited to: (i) use of or inability to use any company products or services; (ii) loss, damage to, or inability to access material, video, audio, or photos captured or recorded through company gear; or (iii) leakage or unauthorized access to materials, video, audio or photos that have not been erased before the rented gear is returned.
Photolet reserves the right to alter, amend, or modify this Agreement from time to time, in its sole discretion. Photolet will provide you with notice of such changes through the website, and such changes shall apply immediately upon your acceptance or within fourteen (14) days upon notice of such changes. In any case, if you do not accept the changes, you must cease to use our services.
This Agreement shall be governed by and interpreted in accordance with the laws of Qatar. Any dispute, difference or claim arising out of or relating to this Agreement, including the existence, validity, interpretation, breach or termination thereof, or any dispute regarding obligations arising out of or relating to it shall be referred to and resolved by the appropriate courts of Doha, Qatar.
Should any provision of this Agreement or part thereof become illegal, invalid or unenforceable, such provision shall then be deemed separable from the remaining provisions of this Agreement and shall not affect the validity or enforceability of the remaining provisions of it.
The customer agrees that Photolet’s failure to exercise or enforce any provision of this Agreement will not constitute a waiver of such right or provision. The customer may not assign this Agreement without the prior written consent of Photolet, but Photolet may assign or transfer this Agreement, in whole or in part, without restriction.
